摘要
监狱会见工作力量的配备对于充分发挥会见功能具有重要意义。应然意义上契合监狱会见功能需求的工作力量配备应具有职业化、专业化和多元化等三个特征。但我国行刑实践中仍然面临着会见执法理念滞后、会见工作力量配备薄弱、会见工作人员职责不够深化统一等诸多现实困境。未来有必要转变监狱会见执法理念、完善监狱会见相关立法规范。会见工作人员会见工作职责不仅局限于维护会见现场的工作秩序,更重要的还在于为会见双方提供动态信息、系统化支持以及加强部门间的沟通联动等,以最大限度地发挥会见功能。
The allocation of work force is of great significance for fully exerting the function of prison visitation.Ideally,the work force that meets the requirements of prison visitation should have three characteristics,namely,professionalization,specialization and diversification.However,in China′s execution practices,there are still many practical difficulties,such as the lagging concept of visitation enforcement,the weak work force for prison visitation,and insufficient deepening and integration for the responsibilities of visitation staff.In the future,it is necessary to transform the concept of prison law enforcement and amend the prison visitation stipulations in Prison Law.In addition,the responsibilities for visitation staff should be expanded to provide dynamic information,systematic support,and more communication and closer linkage between departments to maximize the visitation′s function.
