全面推动乡村管理法治化的价值探索与实践途径

全面推动农村社会管理法治化对我国的社会主义法治体系的思想建设与实际运用有着十分重要的作用,也是全面推进依法治国的必然需要和促进我国治理结构与管理水平实现现代化改革的内在需要,是推进农村社会全面高速发展的实际要求,维护农村村民合法权益的坚实基础,最终实现乡村和平安定的重要保证。不过在全面推动乡村管理法治化的进程中也面临一定的实际问题,因为乡村人员的意识普遍淡漠,造成农户财产权益遭到侵犯的问题非常严峻,加之农户对村庄事务的管理权益遭到过分虚化,乡村公益法治服务力度明显落后,同时乡村管理的国家立法严重不足等,这也为全面推动乡村管理法治化提出一系列的挑战。为面对这一挑战,需要寻求一条实现全面推动农村社会管理规范化的途径,如建立健全管理规范体制,发挥农村自治权力机构的合法功效,逐步完善乡村的公共法治服务建设,着力培养农村法治文化等,以此冲破在全面构建乡村管理规范化过程中的严峻障碍。

Comprehensively promoting the legalization of rural social management plays a vital role in the ideological construction and practical application of China's socialist legal system.It is also an inevitable need to comprehensively promote the rule of law and an inherent need to promote the modernization of China's governance structure and management level.It is a practical requirement to promote the comprehensive and rapid development of rural society,a solid foundation for safeguarding the legitimate rights and interests of rural villagers,and an important guarantee for ultimately realizing rural peace and stability.However,in the process of comprehensively promoting the legalization of rural management,there are also certain practical problems.Because the awareness of rural personnel is generally indifferent,the problem of infringement of farmers'property rights and interests is very serious.In addition,farmers'management rights and interests in village affairs have been excessively blurred.Rural public welfare legal services are obviously lagging behind,and national legislation on rural management is seriously insufficient.This also poses a series of challenges for comprehensively promoting the legalization of rural management.In order to face this challenge,it is necessary to seek a way to comprehensively promote the standardization of rural social management,such as establishing and improving the management standardization system,giving full play to the legitimate functions of rural autonomous power agencies,gradually improving the construction of public legal services in rural areas,and focusing on cultivating rural legal culture.,etc.These are essential in breaking through severe obstacles to building rural management standardization.
