食品安全责任险在我国的应用困境与破解——以吉林省情况为例

The Application Dilemma and Solution of Food Safety Liability Insurance in China:A Case Study of Jilin Province

根据2023年第四季度吉林省受理因食品消费对人体健康造成伤害的消费投诉情况,本文指出,因食品消费对人体健康造成伤害的责任认定难导致的消费调解成功率低的问题长期存在。食品安全责任保险被视为解决之道。为此,本文进一步分析了食责险的定义和制度安排、食责险与民事赔偿的契合性及在民事赔偿中起到的积极作用,以及食责险在推广中存在的问题,阐释如何完善食责险的制度安排及其应用,以便发挥其在解决食品安全民事赔偿中的作用,同时对未来食责险推广方式进行探讨。

Based on the consumer complaints handled in Jilin Province during the fourth quarter of 2023 related to food consumption causing harm to human health,this paper points out that the long-standing problem of low success rates in consumer mediation due to difficulties in determining responsibility for food consumption-related health harm persists.Food safety liability insurance(FSLI)is seen as a potential solution.To this end,this paper further analyzes the definition and institutional arrangements of FSLI,its compatibility with civil compensation and the positive role it plays in civil compensation,as well as the problems existing in the promotion of FSLI.The purpose is to explain how to improve the institutional arrangements and application of FSLI in order to play its role in resolving civil compensation issues related to food safety,while also envisioning the future promotion methods of FSLI.
