摘要
中华法系是中华法律文化发展至鼎盛阶段(即隋唐时期)形成的以中国为母法国,以日本、朝鲜等为子法国的法律体系。近代以来,中华法系经历了母法国和子法国法律近代化中与原先法律体系的分离,这种分离背后的母法国和子法国法律却延续了诸多原先法律体系中的理念或制度元素,反映出中华法系作为中国古代法的传统与象征,以及作为中华民族伟大复兴和世界法律文明重要组成的重要价值。及至当下,中华法系之优秀元素的传承、创新,在文化、学科、学术及教育层面,可以分别通过中华法系之元素融入中华法律文化之转型、法学学科学术话语体系的构建、中西方法治现代化之对比研究、中华法系之元素的课程化与普及化、民众化等路径,为我国社会主义法治建设提供资源和养料。
The Chinese Legal System is a legal system formed upon the development of Chinese legal culture reaching its peak(during the Sui and Tang dynasties),with China as the state of mother law and Japan,Korea ect.as the states of subordinate law.Since modern times,the Chinese Legal System has seen the separation of the state of mother law and the states of subordinate law from the original legal system in their legal modernization,however the laws of the state of mother law and the states of subordinate law behind such separation has carried forward many ideas or institutional elements of the original legal system,showing the significant value of Chinese Legal System as the tradition and symbol of ancient Chinese law and an integral part of the great rejuvenation of Chinese nationality and the world legal civilization.Today,the inheritance and innovation of outstanding elements of Chinese Legal System,at the levels of culture,discipline,academic research and education,may be achieved respectively by means of integrating the elements of Chinese Legal System into the transformation of Chinese legal culture,establishing the discipline and academic discourse system for the legal science,conducting comparative research on the modernization of Western and Chinese rule of law,and incorporating the elements of Chinese Legal System into curricu la and promoting their popularity among the public,thus providing resources and nutrients for the deve lopment of socialist rule of law in China.
