经济法的学理化:理论省思与实践进路

On the Academicization of Economic Law:Theoretical Reflection and Practical Approach

当前我国经济法理论对经济法事实和现象的描述能力和解释力仍存在不足,经济法学研究因一般理论的孱弱而面临范式危机,不仅使经济法规范难以达成体系融贯,而且造成经济法的形式理性与价值理性难以彰显。这些现实困境共同指向了经济法学理化的内在要求,经济法学理化的目标是实现科学化与哲理化的有机统一。为此,应逐步以规律性认识代替价值判断以提升经济法的逻辑连贯性,以价值平衡作为经济法体系化的基准,以反思性视角替代建构性视角提炼经济法的一般理论,并引入跨学科分析方法构建经济法特色分析范式。在实践层面,需要强化经济法领域内法律的基础性地位并设计科学程序来约束立法过程,经济法的实施既须从既有实践中提炼出完善经济法基础理论的知识资源,也需要通过强化规范解释的地位克制经济司法与经济执法中的主观裁量。

The ability of current theories on economic law in China to describe and explain the facts and phenomena of economic law is still insufficient,and the research into economic law is facing a paradigm crisis because of the weakness of the general theory,which not only makes it difficult to achieve systematic coherence of norms in economic law,but also causes difficulties in demonstrating the formal rationality and value-based rationality of the economic law.These realistic predicaments jointly point to the internal demand of the academicalization of economic law,the goal of which is to realize the organic unity of scientificization and philosophization.Therefore,it is advisable to gradually replace the value-based judgment with law-based cognition to enhance the logical coherence of economic law,take the balance among values as the basis of the systematization of economic law,extract the general theory of economic law from a reflective perspective instead of a constructive perspective,and introduce the method of interdisciplinary analysis to construct the analysis paradigm with characteristics of economic law.At the practical level,it is necessary to enhance the basic status of law in the field of economic law and design scientific procedures to restrict the legislative process.Regarding the implementation of economic law,it is imperative to both extract knowledge resources for improving basic theories of economic law from the existing practice and strengthen the status of normative interpretation to limit the subjective discretion in economic judicial practice and law enf orcement.
