认购碳汇替代性修复责任适用优化路径研究

Research on the Optimization Path of Applying Alternative Restoration Responsibility of Carbon Sink Subscription

认购碳汇是我国法院贯彻司法能动精神将环境保护与环境司法相结合的替代性修复责任新模式。为保障这一新模式的高效运行,应明确其所依据的法律规范及其理论基础为其适用提供正当性支撑,并从司法实践适用的角度出发,归纳认购碳汇的适用要件。在此基础上提出优化建议:统一规范碳汇损失的核算方法与标准;优化碳汇市场交易规则;强化认购碳汇的监督机制。冀通过这些措施的实施进一步完善认购碳汇机制,为生态环境保护贡献司法力量。

Carbon sink subscription is a new model of alternative remediation responsibility adopted by Chinese courts to implement the proactive spirit of justice and combine environmental protection with environmental justice.To ensure the efficient operation of this new model,it is necessary to clarify the legal norms and theoretical basis upon which it is based,providing justification for its application.From the perspective of judicial practice,the applicable requirements for carbon sink subscription are summarized.Based on this,the optimization suggestions are proposed:unifying the calculation methods and standards for carbon sink losses,optimizing the trading rules of the carbon sink market and strengthening the supervision mechanism for carbon sink subscription.Through the implementation of these measures,the carbon sink subscription mechanism will be further improved,contributing judicial power to ecological and environmental protection.
