个人隐私权的享有,作为人类社会不可或缺的基本人权要素,其充分实现与妥善维护,需深植于社会经济结构的土壤之中。步入数字化时代,数字平台的广泛普及与技术创新呈现出井喷态势,极大地丰富了人们的生活方式,拓宽了行为边界。然而,这一变革也伴随着个人隐私权保护领域的严峻考验。传统上,隐私权保护聚焦于物理空间及个体私人领域的捍卫,但在当前信息技术日新月异的背景下,信息通信技术的飞跃性发展已悄然模糊了私人领域与物理空间的传统界限。个人隐私的边界不再囿于家庭四壁或职场环境,而是无远弗届地延伸至数字平台的广阔虚拟空间,这一变化对现有保护机制构成了重大挑战,使之难以有效应对数字时代的复杂情境。鉴于此,本研究聚焦于数字平台环境下隐私权保护的新议题,旨在通过深入剖析当前法律理论与规则的适应性,探索适应数字平台特性的隐私权保护新模式与规则体系,旨在平衡数字平台创新发展与个人隐私权益保护之间的张力,为数字经济的可持续发展奠定坚实的法律基础。

The enjoyment of personal privacy rights,as an indispensable basic human rights element in human society,can only be fully realized and properly maintained by deeply rooting it in the soil of social and economic structures.In the era of digitalization,the widespread popularity and technological innovation of digital platforms have presented an explosive trend,greatly enriching people’s life-styles and broadening their behavior boundaries.However,this transformation also brings serious challenges to privacy rights protection.Traditionally,privacy rights protection has focused on de-fending physical spaces and individual private domains.However,in the context of the rapid devel-opment of information and communication technology,the leapfrog development of information communication technology has subtly blurred the traditional boundaries between private domains and physical spaces.The boundaries of personal privacy no longer confine themselves to the four walls of the home or the workplace,but extend virtually unbounded to the vast digital platform space.This change poses a major challenge to existing protection mechanisms,making it difficult for them to effectively respond to the complex situations of the digital age.Therefore,this study focuses on the new issues of privacy rights protection in the digital platform environment,aiming to explore new models and rule systems of privacy protection that are suitable for the characteris-tics of digital platforms through in-depth analysis of the adaptability of current legal theories and rules.The goal is to balance the tension between the innovative development of digital platforms and privacy rights protection,thereby laying a solid legal foundation for the sustainable develop-ment of digital economy.
