长租模式下各方法律关系之检视

The Review on the Legal Relations under the Long-Term Renting Model

摘要 随着“租购并举”住房制度改革的推进,长租公寓品牌呈爆发式增长。然而繁荣背后,空置率高、资金链断裂、用户体验下降等问题逐渐暴露。一旦长租公寓服务商卷款跑路,房东收不到租金,租户则承担无家可归和继续还贷双重风险。此时,认定房东、服务商、租户以及网贷平台之间的法律关系意义重大,其中,房东与蛋壳公寓签订的合同系委托合同抑或租赁合同之争将成为突破点。从合同内容出发,应将其定性为具备中介合同内容、委托合同内容以及委托代理合同内容的混合合同。 With the moving forward of“dual rental and purchase”,a housing system reform,the brand of longterm rental apartments has experienced explosive growth.However,behind the superficial bubble,we found problems such as high vacancy rates,capital chain rupture and declining user experience.After the exit of the long-rent apartment service providers,the landlord was unable to charge the rent,and the tenant was exposed to the risk of homelessness and the pressure of debt redemption.In this case,the determination of the legal relations between the landlord,the service provider,the tenant and the Internet loan platform is of great significance to the solution of this problem.And also,the dispute about the nature of the contract signed by the landlord and Danke apartment will be a breakthrough.From the content of the contract,it should be characterized as a mixed contract with the content of intermediary contract,principal contract and principal agent contract.
