地摊经济中消费者权益法律保护问题研究

Study on the Legal Protection of Consumer Rights and Interests in the Street-Stall Economy

“地摊经济”作为长久以来活跃在社会发展的一种非正式的经济形式,在特定时期为解决就业率问题、经济滞后问题等发挥了一定的作用。“地摊经济”因其低门槛、低成本、低风险的特征吸引众多从业者加入这一行业。但是也因其特征,使得其相关的消费行为出现不正规的现象,侵害消费者的知情权、求偿权以及人身和财产权。为了行业的发展,也为了保障消费者和经营者的合法权益,完善行业立法、加强执法监督以及提高消费者的维权意识成为解决现存问题的重要途径。

As a form of informal economy that has long been active in social development,the“street-stall economy”has played a role in solving the problems of employment and economic lag in a certain period of time.Because of its characteristics of low threshold,low cost and low risk,the“street-stall economy”has attracted many practitioners to join the industry.However,because of its characteristics,it has also led to the emergence of irregularities in consumer behavior,infringing on consum-ers’rights to know,to seek compensation,and to personal and property rights.For the development of the industry and to protect the legitimate rights and interests of consumers and operators,improving industry legislation,strengthening law enforcement supervision and raising consumers’awareness of their rights have become important ways to solve existing problems.
