[研究目的]在当今这个信息化高速发展的时代,数据已悄然跃升为不可或缺的财富资源,其资产属性愈发凸显,成为推动经济社会发展的新引擎。随着大数据、云计算等技术的广泛应用,数据的价值被深度挖掘与利用。然而,这也使得数据财产的法律保护问题日益严峻,成为社会各界关注的焦点。[研究方法]通过对文献的分析与总结,从知识产权与数据财产的相似性为切入点,再运用比较分析法,通过与欧盟、美国、日本、韩国等在数据财产知识产权保护方面的立法和实践经验的对比,分析各自的优劣点,并借鉴其成功做法。梳理出知识产权法对数据财产保护的不足以及相对应的完善路径。[研究结论]在当前知识产权保护体系中,专门针对数据财产的法律条款尚不完善,无论是传统的知识产权专门法还是反不正当竞争法,在应对数据保护的新挑战时均显露出不足,难以全面有效地保障数据权利人的合法权益。因此,构建完善的数据财产保护体系迫在眉睫,需要从加强知识产权专门法的修订与补充、建立健全数据财产登记制度、完善救济制度等多个维度入手,构建起适应数字经济时代需求的数据财产保护法律体系。

[Research purpose]In today's era of rapid development of information technology,data has quietly become an indispensable wealth resource,its asset attributes are increasingly prominent,and become a new engine to promote economic and social development.With the wide application of big data,cloud computing and other technologies,the value of data has been deeply explored and utilized.However,this also makes the problem of legal protection of data property increasingly serious,which has become the focus of all sectors of society.[Research method]Through the analysis and summary of literature,starting from the similarity of intellectual property and datap roperty,and then using comparative analysis method,the advantages and disadvantages of each country are analyzed by comparing the legislation and practical experience of data property intellectual property protection with that of other areas(EU,USA,Japan and Republic of Korea),and the successful practices of other countries are learned from.This paper combs out the deficiencies of data property protection in intellectual property law and the corresponding improvement pathways.[Research conclusion]In the current intellectual property protection system,the legal provisions specifically for data property are not perfect,and both the traditional intellectual property law and the anti-unfair competition law show deficiencies in responding to the new challenges of data protection,and it is difficult to fully and effectively protect the legitimate rights and interests of data right holders.Therefore,it is urgent to build a perfect data property protection system,and it is necessary to start from several dimensions,such as strengthening the revision and supplement of the special law on intellectual property,establishing and improving the data property registration system,and improving the relief system,to build a data property protection legal system that meets the needs of the digital economy era.
