摘要
网络游戏外挂适用计算机罪名规制符合网络空间安全法益保护趋势,针对当前计算机犯罪罪名适用中鉴定意见前置性技术原理证据支撑不足、“侵入、非法控制”技术与法律判断分歧以及电子数据取证滞后、目的性限缩下“技术措施”条款适用障碍等难点,应建构体系化、层次化证据审查思维,注重从电子数据、鉴定意见等技术性客观证据切入,厘清底层的技术原理逻辑,重点从技术措施“设置—规避”目的和有效性、规避技术例外规则情形等证据要件进行正反向审查,克服技术措施本身的随附困境,综合认定网络语境下具体犯罪行为的法律属性,从而形成从证据到事实到法律定性的完整认定进路,实现刑法规制的预期目的和效果。
Regulating online game cheating by computer crime charges is in line with the trend of protecting the legal interests in cyberspace security.In view of current challenges in computer crime charges,such as expert's inability in providing opinions on the preliminary technical issues,the divergence of opinion between technology expert and legal expert regarding the conduct of intrusion and unauthorized access",the delayed electronic data forensics,and the obstacles to the application of the"technical measures"clause under the purpose limiting policy,it is necessary to construct a systematic and hierarchical evidence assessment mindset.Emphasis should be placed on technical evidence,such as electronic data and expert opinions to clarify the underlying logic of technical principles.In order to overcome technical measures'inherent dificulties,attention should be fixed on examining evidence elements by both positive and negative tests,which include the purpose and effectiveness of"installationcircumvention"of the technical measures,exceptions to the technical circumvention,and etc.By applying the aforementioned comprehensive methods,the legal status of specific criminal activities in the network will be identified,and thus a full approach to tackle such criminal activities will be established based on the determination of evidence,facts and legal status.By doing so,the expected purpose and effect of criminal law will be achieved.
