人类命运共同体理念融入我国法律体系是以法治方式推动构建人类命运共同体的重要理论与实践命题。人类命运共同体理念经由习近平总书记提出,并通过我国《宪法》的宣示开启了融入我国法律体系的时代进程,具有统筹“两个大局”下推进全面依法治国和以法治互动规律推动人类命运共同体理念国际法化的理论逻辑。人类命运共同体理念的融入实践初步呈现出规范表述、规范地位和规范层次的差异化样态,其融入范围应以特定法律关系与人类命运共同体理念的关联程度为判断标准,避免简单排除非涉外性法律、私法性法律和法规、规章及规范性文件。应当坚持从实际出发,运用“立、改、废、释、纂”并举和“直接与间接”融入相结合的方式,不断提升人类命运共同体理念在语言表述和价值层次方面的严谨性,以法律原则和法律规则为载体强化具体制度设计,使我国法律能充分反映人类命运共同体理念的思想精髓。

It is an important theoretical and practical issue to integrate the idea of a global community of shared future into China's legal system to promote the building of a global community of shared future by the rule of law.The idea of a global community of shared future was propounded by General Secretary Xi Jinping,and the declaration of China's Constitution initiated the era process of integration into China's legal system.It has the theoretical logic of promoting the comprehensive advancement of law-based governance and advancing the international legal institutionalization of the idea of a global community of shared future with the interaction of rule of law in the context of coordinating the“Two Overall Situations”.Integrating the idea of a global community of shared future initially presents a differentiated pattern of normative expression,normative status,and normative level.Its integration scope should be judged by the degree of correlation between specific legal relations and the idea of a global community of shared future,avoiding simply excluding non-foreign related laws,private laws and regulations,rules,and normative documents.China should persist in proceeding from the actual situation,adopt the combination of“legislation,amendment,abolishment,interpretation,and codification”and“integrating directly and indirectly”to continuously improve the standardization of the idea of a global community of shared future in terms of language expression and value level,and at the same time strengthen the specific system design with legal principles and legal rules as the carrier so that our laws can fully reflect the ideological essence of the idea of a global community of shared future.
