实现碳达峰碳中和目标是具有全局性、战略性的系统性工程。碳达峰碳中和愿景的实现必然触及多领域多行业主体的利益,相关利益的冲突与协调呼吁统一立法。“碳达峰碳中和”目标下专项立法应以绿色可持续发展为总目标,立法体例上要突出系统性、多维性和协同性,调整范围上应围绕环境利益、绿色发展、环境公平与正义等展开。在内容要义上,“碳达峰碳中和”目标下专项立法应当包括绿色发展和降碳增汇等实体法内容,并辅之以科学管理、科技创新、奖惩措施、法律责任等保障内容。

Achieving carbon peak and carbon neutrality goals is a comprehensive,strategic,and systemic project.The realization of the carbon peak and carbon neutrality vision will inevitably affect the interests of multiple fields and industries,and the conflict and coordination of relevant interests call for unified legislation.Special legislation under the goal of“carbon peak and carbon neutrality”should take green and sustainable development as the overall goal,emphasize systematic,multi-dimensional,and synergistic approaches in legislative design,and cover areas such as environmental interests,green development,environmental equity,and justice.In terms of content,the special legislation under the goal of“carbon peak and carbon neutrality”should include substantive legal elements such as green development and enhancement of carbon sinks,supplemented by scientific management,scientific and technological innovation,reward and punishment measures,legal liability,and other safeguards.
