我国医疗保障基金监管的法理阐释与优化路径

Jurisprudential Interpretation and Optimization Path of Medical Security Fund Supervision in China

医疗保障基金关乎民众的基本医疗需求和紧急救治,强化医疗保障基金监管具有必然性和现实需求。目前,公共利益监管理论、政府监管理论、社会保障知情权理论为医疗保障基金监管奠定了充分的理论基础,我国也已构建了多层次、系统化的医疗保障基金监管框架。强化医疗保障基金监管需加强医疗保障基金监管队伍建设,完善医疗保障基金信息披露制度,构建事前事中事后全环节监管机制,积极引入第三方监管力量。

The medical security fund is related to the basic medical needs and emergency treatment of the people,so it is necessary and realistic to strengthen its supervision.At present,the public interest regulation theory,the government regulation theory and the right to know theory of social security provide sufficient theoretical basis for the regulation of medical security funds,and China has built a relatively perfect multi-level and systematic regulatory framework for medical security funds.To strengthen its supervision,we should enhance the construction of medical fund supervision team,improve its information disclosure system,construct the supervision mechanism of all links before,during and after it,and actively introduce the third-party supervision force.
