数字时代我国公共卫生危机之应对预警制度的缺陷与完善

Defects and Perfection of China's Public Health Crisis Warning System in Digital Age

我国应对公共卫生危机的预警制度存在缺陷,主要是危机信息的收集系统设计不合理、监测与预警制度被人为割裂、预警主体在法律上设定不一致等,致使公共卫生事件的防控有困难;在“数字中国”建设背景下当反思我国公共卫生危机之应对预警制度,优化制度设计,尤应借助数字化手段对其实施必要改革,以助益我国公共卫生事件应急防控的法治化建设。

There are shortcomings in early warning system to deal with the public health crisis in China,mainly involving the un⁃reasonable design of the crisis information collection system,the artificial separation of the monitoring and early warning system,and the inconsistency of the warning subject in the law,which makes it difficult to prevent and control public health incidents.In the con⁃text of the construction of"digital China",we should reflect on the early warning system of public health crisis in China,optimize the system design,especially carry out the necessary reform with the help of digital means,so as to help the rule of law construction of the emergency prevention and control of public health incidents in China.
