摘要
根据我国现行的法律规定,互联网医疗的“诊疗范围”仅限指对常见病、慢性病的复诊,而禁止互联网平台向患者提供首诊服务。但现行规定却存在对“咨询”和“诊疗”的界定模糊,对“常见病”“慢性病”的界定不明确,对“首诊”审核缺少明确的程序要求,以及其关于互联网“诊疗范围”的相关规范也适用性不强;应严格监管互联网平台违反“诊疗范围”相关规定的行为,有必要严格区分医疗的“咨询”和“诊疗”之所指,明确且适度扩大互联网医疗的“诊疗范围”,并细化目前关于“首诊”的规定,且明确其审核程序,完善互联网诊疗的相关配套制度及现行法律制度,以提高互联网医疗服务的规范性和可靠性。
According to China's current laws and regulations,the"diagnosis and treatment scope"of Internet healthcare only re⁃fers to the subsequent visit of common diseases and chronic diseases,and Internet platforms are prohibited from providing first diagno⁃sis to patients.However,the current regulations have vague definitions of"consultation"and"diagnosis and treatment",unclear defini⁃tions of"common diseases"and"chronic diseases",lack of clear procedural requirements for the"first diagnosis"review,and weak ap⁃plicability of the relevant norms on the Internet"diagnosis and treatment scope".Therefore,it is necessary to strictly monitor Internet platforms’violation of the relevant provisions of the"diagnosis and treatment scope",strictly distinguish"consultation"and"diagnosis and treatment"of medical treatment,clearly and moderately expand the"diagnosis and treatment scope"of Internet healthcare,specify the current provisions on"first diagnosis",clarify its review procedures,and improve the relevant supporting system of Internet health⁃care and the current legal system,so as to improve the standardization and reliability of Internet healthcare.
