Compensation Strategies for Forest Resources Damage

科学处置自然资源损害赔偿是探索自然资源资产所有权委托代理机制试点的重要内容。厘清自然资源损害赔偿中的主要问题与主要矛盾,是实现自然资源增值保值的重要保障,是保障全民所有者权益的有效手段。文中阐述了目前森林资源损害评估的现状,提出了森林资源损害赔偿面临的问题,包括损害鉴定内容不完善、处罚理论依据不充分、赔偿管理体系不健全;针对目前的问题,提出了应对策略:1)建立科学系统的损害鉴定机制;2)加强规章制度建设与互动协调;3)完善管理与定期督导;4)推广环境责任保险工作与业务。研究可为全民所有自然资源资产所有权委托代理机制工作的开展提供理论支撑与参考。

The science-based compensation for damages to natural resources is an essential part of the pilot for the principal-agent mechanism for the ownership of natural resources assets to all people.Clarifying the key issues and main conflicts in the compensation for natural resources damage is important to realize the value-addition and preservation of natural resources and protect the rights of the owners.The paper elaborates on the current situation of the evaluation of the damage to forest resources,and identifies the problems,such as incomplete appraisal of damages,insufficient basis for penalties,and inadequate supervision system for compensation.In view of the problem,we put forward the strategies:1)establishing damage appraisal mechanism which is science-based and systematical;2)building the institutional framework,and strengthening interaction and coordination;3)improving the measures for budget,incomes and compensation;4)promoting insurances for the environment responsibility.This study would supply theoretic basis and references to develop the principal-agent mechanism of the ownership of state-owned natural resources assets.
