数字平台是激活数据要素的重要经济中枢,平台间数据互联互通既是促进数据要素高效、科学流通的直接驱动力,也是数字经济高质量发展的重要保障。现有理论研究多着眼于防范数据互联互通过程中的各类风险,重视对监管制度的优化和完善。然置于数字经济发展的全球视野中,发展应当置于与安全同等重要的位置。对此,应当充分发挥法律的激励功能,平衡数字平台的公共性和私利性冲突,打造激励相融的监管体系,构建阶梯式激励框架,将自上而下单向干预数字平台经营发展的监管思路转变为激励平台为追求共同利益而自发形成的自治理念,实现政府与平台间双向良性互动,优化数据互联互通的实施效果。

Digital platforms are important economic centers that activate data elements.Data interconnection and intercommunication between platforms are not only the direct driving force for promoting efficient and scientific circulation of data elements,but also an important guarantee for the high-quality development of the digital economy.The existing research in the theoretical field mostly focuses on preventing various risks in the process of data interconnection and emphasizes the optimization and improvement of regulatory systems.However,in the global perspective of digital economy development,development should be placed in an equally important position as security.In this regard,the incentive function of the law should be fully utilized,balancing the conflict between the public and private interests of digital platforms,creating a regulatory system that integrates incentives,constructing a hierarchical incentive framework,and transforming the regulatory approach of top-down one-way intervention in the operation and development of digital platforms into an autonomous concept that encourages platforms to spontaneously form in pursuit of common interests.This will achieve a mutually beneficial interaction between the government and platforms,optimize the implementation effect of data interconnection.
