党领导教育事业入法的法治逻辑

摘要 党领导教育事业入法经历了从混合性立法确认、国家层面立法不直接规定、特定立法直接规定、教育立法趋向全面推进的演进历程。党领导教育事业入法的法理考量是:确立党领导教育事业的主体地位法定化、推动法治保障党领导教育事业权威的体系化、促进党领导教育事业职权范围的规范化。当前的制度规范依然存在入法标准不明晰、立法数量有限、原则性规范过多、法律责任缺失、党规与国法衔接不畅等问题。因此,需要构建科学的入法标准、建立完备的法律规范体系、增加具体明晰的规则性条款、构筑完善的党内法规体系,推进党对教育事业的领导走向法治化、规范化、制度化。 The Party’s leadership in education industry into law has gong through an evolutionary process of mixed legislation confirmation,national level legislation not directly stipulating,specific legislation directly stipulating,and comprehensive promotion of education legislation.The legal considerations for the inclusion of the Party’s leadership in education in the law are:establishing the legal status of the Party’s leadership in education,promoting the systematization of the rule of law to safeguard the authority of the Party’s leadership in education,and contributing to the standardization of the scope of the Party’s leadership in education.The current institutional norms still have problems such as unclear entry standards,limited legislative quantity,excessive principled norms,lack of legal responsibility,and poor connection between Party rules and national laws.Therefore,it is necessary to establish scientific entry standards,construct a complete legal regulatory system,add specific and clear rules and regulations,and build a sound system of internal Party regulations to promote the Party’s leadership in education towards legalization,standardization,and institutionalization.
