党领导教育事业入法的法治逻辑

党领导教育事业入法经历了从混合性立法确认、国家层面立法不直接规定、特定立法直接规定、教育立法趋向全面推进的演进历程。党领导教育事业入法的法理考量是:确立党领导教育事业的主体地位法定化、推动法治保障党领导教育事业权威的体系化、促进党领导教育事业职权范围的规范化。当前的制度规范依然存在入法标准不明晰、立法数量有限、原则性规范过多、法律责任缺失、党规与国法衔接不畅等问题。因此,需要构建科学的入法标准、建立完备的法律规范体系、增加具体明晰的规则性条款、构筑完善的党内法规体系,推进党对教育事业的领导走向法治化、规范化、制度化。
