湖南省水权确权的困境与出路

Difficulty and Outlet of Confirming Water Right in Hunan Province

水权确权是中国进行水权交易的必要前提,只有将水资源资产化,才能更好管理和盘活我国水资源。中国水权确权工作已在全国范围内铺开,湖南省正逐步贯彻这一立法政策。虽然实践上已经取得了部分成果,但目前仍然存在水流登记单元划定标准不一、确权主体权责不明以及立法保障缺位等问题。对此需要明晰水流登记单元划定、合理配置权利行使主体权责、完善立法保障,进一步推动湖南省水权确权的进程。

Water right confirmation is a prerequisite for water right trading inChina,only by leveraging water resources can effectively manage and revitalizeChinese resources.The work of water right confirmation has been widely implemented throughout the country,and Hunan Province is gradually enacting this legislative policy.While some progress has been made in practice,there are still issues such as varying demarcation standards for water flow registration units,unclear rights and responsibilities of the subject of right confirmation,and a lack of legislative protection.Therefore,it is necessary to clarify the delineation of water flow registration units,allocate the rights and responsibilities of the right exercise subjects rationally,improve legislative protection,and further promote the process of water right confirmation in Hunan Province.
