数字时代算法歧视的风险与治理研究

The Risk and Governance of Algorithmic Discrimination in the Digital Society

算法、数据与算力是数字时代重要的资源,但算法开源、黑箱与数据,外部的经济、文化与法律等因素带来了算法歧视风险。应聚焦科技与法律的双阶层治理结构,在技术治理上建立核心价值根嵌入算法设计中,从源头上避免算法歧视;建立客观、公正的人工标注数据池,在逻辑输入上驯服算法,从过程上避免算法歧视。在法律治理上逐步建立算法安全审查机制,在动态中检验算法;保障公众的算法知情权,建立算法歧视问责机制、算法歧视救济机制,以应对算法歧视。

Algorithms,data and computing power are important resources in the digital age,but open source algorithms,black boxes and data,external economic,cultural and legal factors altogether have brought the risk of algorithmic discrimination.We should focus on the two-level governance structure of science and technology and law.In terms of technology governance,we should establish the core value root embedded in the algorithm design to avoid algorithmic discrimination at the source;we should also establish an objective and fair manual data annotation pool,and tame the algorithm in logic input to avoid algorithmic discrimination in the process.In the legal governance,the algorithmic security review mechanism should be gradually established to test the algorithm dynamically;the public’s right to know algorithm should be guaranteed and the algorithmic discrimination accountability mechanism and relief mechanism should be established to deal with algorithmic discrimination.
