Historical Exploration,Practical Experience and Improvement Suggestions of the Summary Procedure of Administrative Review

我国行政复议简易程序制度的发展呈现“地方—中央”立法演进特征,先后经历了萌芽、勃发和成型三个阶段,并在地方探索过程中形成了重视细化流程、创新标准和数字赋能的实践经验。当前,各界对行政复议简易程序制度抱有较大期待,但也要注意到行政复议简易程序在实施过程中已经存在制度设计规范性不足、职权主义色彩过于浓厚等问题。因此,为了更好地发挥行政复议简易程序制度的功能,应当从细化程序步骤流程、简化程序关键内容、优化程序速裁机制、强化审理人员素养和深化数智化复议应用五个方面,对行政复议简易程序制度进行完善。

The development of the summary procedure system of administrative review in China presents the characteristics of the evolution path of“local exploration—national legislation”,which has experienced three stages:germination,blossoming and forming.In the process of local exploration,the implementation experience of attaching importance to the detailed process,innovative standards and digital empowerment has been formed.At present,all walks of life have great expectations for the summary procedure of administrative review,but it should also be noted that there are already some problems,such as insufficient standardization of system design and too strong functionalism.Therefore,in order to better play the function of the summary procedure of administrative review,the system of summary procedure of administrative review should be improved from five aspects:refining the procedure step flow,simplifying the key content of the procedure,optimizing the quick adjudication mechanism of the procedure,strengthening the quality of the hearing personnel and deepening the digital intelligence of the review.
