我国《劳动法》颁布三十年的回顾与思考——以劳动法体系化为视角

A Review and Reflection on the 30th Anniversary of the Promulgation of China's Labor Law:From the Perspective of the Systematization of the Labor Law

我国《劳动法》颁布后的30年是伴随着劳动制度市场化改革的劳动法体系化的30年。比较《劳动法》与其后续劳动立法的内容可知,《劳动法》在固定改革方向、确立价值取向、展示制度框架上为劳动法体系化奠定了基础,也在劳动法体系化中显露出保护范围偏窄、劳动关系类型化不够、保护手段配置分层化欠缺等不足。为进一步彰显《劳动法》对劳动法体系化尤其是走向法典化的意义,应当以《劳动法》修改来统领单行劳动法律制定和修改,并在修改中提升法律位阶、完善分则体系、调整内容范式,着力于保护范围适度扩宽与保护手段分层配置相匹配以及劳动者保护的跨业态安排。

The 30 years since the promulgation of China's Labor Law has been a period of systematization of labor law and the reform of the market-oriented labor system.Comparing the content of the Labor Law and its subsequent labor legislation,it can be seen that the Labor Law has laid the foundation for the systematization of labor law in terms of fixing the direction of reform,establishing the value orientation,and displaying the basic framework,but it has also revealed the deficiencies such as a narrow scope of protection,insufficient typology of labour relations,and a lack of hierarchical allocation of means of protection,etc.In order to further highlight the significance of the Labor Law to the systematization of labor law,especially to its codification,on the one hand,the revision of the Labor Law should lead the formulation and amendment of individual labor laws,and on the other hand,the revision of the Labor Law should be paid attention to,and in the revision,the legal status should be upgraded,the system of sub-rules should be perfected,the paradigm of the content should be adjusted,and the efforts should be made to the moderate expansion of the scope of protection,the stratified allocation of protection means,and the inter-industry arrangement of the protection of the workers.
