《民营经济促进法》的逻辑基础与制度表达

Logical Basis and Institutional Expression of Private Economy Promotion Law

我国“1+N”的民营经济政策体系已基本形成,然而,作为我国现代化建设的重要保障,民营经济在高质量发展的过程中存在一定阻碍,《民营经济促进法》的制定切实必要可行。立法工作应当以解决民营经济发展面临的实际挑战为出发点,平衡促进型规范与限禁型规范,构建多元共治格局,正确处理好与《中小企业促进法》《公司法》等既有法律的关系,全面审视并合理扬弃既有地方立法成果。在总则部分,明确“保障民营经济组织合法权益、营造民营经济发展友好环境、引导民营经济高质量发展”的立法目的,树立以平等保护为核心的基本原则。在具体制度设计上,着重关注本次立法的可操作性,确立市场准入标准、信用体系建设、产权保护、政企沟通、激励考核、政策法规评估及备案审查等系列制度,同时明确公权力机关、商会等主体的权责配置。

China has formed a“1+N”policy system for the private economy.However,as an important guarantee for China's modernization,the private economy is still hindered in the process of high-quality development.Private Economy Promotion Law is still necessary and feasible.The legislative work should take addressing the actual challenges faced in the development of private economy as the starting point,balance promotional norms and prohibitive norms,build a multi-governance pattern,correctly handle the relationship with existing laws such as the Law on Promotion of Small and Medium-sized Enterprises and the Company Law,comprehensively review and reasonably sublate existing local legislative achievements.In the part of general provisions,the protection of the legitimate rights and interests of private economic organizations,the creation of a friendly development environment for private economy and the guidance to the high-quality development of the private economy should be taken as the purpose of the law and the basic principle of equal protection should be constructed.In the design of specific rules,the law should focus on the operability of this legislation,establish a series of systems such as market access standards,credit system construction,property rights protection,government-enterprise communication,incentive assessment,policy and regulation evaluation and filing review,and at the same time clarify the power and responsibility allocation of public power organs,chambers of commerce and other subjects.
