近年来,受文娱产业的带动,“道德条款”被引入到职业体育领域,成为预防与惩罚职业运动员言行道德失范的重要手段。该条款所拥有的行为规训、责任切割、损害补救等多种机能,使其不仅在体育商业代言、赞助中得到应用,也在体育劳动合同、人才培养及其行业管理方面得到了推广。然而,该条款在职业体育领域中的应用时间较短,并且尚未与体育深度融合,以致出现了边界模糊、过度扩张、与隐私保护冲突等隐患。为了排除这些应用隐患、发挥其应有机能,应当在厘清道德失范行为边界的基础上,划定合理的适用范围,兼顾职业运动员个人隐私保护与权利保障,为体育事业的健康发展保驾护航。
