网络猥亵未成年人入罪的理论证成与司法适用

Theoretical Evidence and Judicial Application of Criminalizing Online Molestation of Minors

网络猥亵行为隔空实施的特点使其在司法适用中存在争议。目前司法解释对网络猥亵未成年人可以构成猥亵犯罪已有明确规定,而最有利于未成年人原则、从严惩处性侵未成年人犯罪及隔空防范规范原理为网络猥亵未成年人入罪提供了理论基础。依据客观解释论,强制猥亵罪、猥亵儿童罪的构成要件要素“猥亵”的内涵应当包括“网络隔空猥亵行为”。在司法适用上,厘清网络猥亵未成年人犯罪中“猥亵”行为、“强制”手段及“公共场所当众”的认定思路,可以为实践中准确认定和处理此类案件提供借鉴和参考。

The application of the online molestation of minors is controversial in judicial practice because it happens across separated places.At present,judicial interpretations have clearly stipulated that online molestation of minors can constitute the crime of molestation.The principle of being most beneficial to minors,severe punishment of sexual assault to minors,and principles of cross-space defense specifications provide theoretical basis for the incrimination of the online molestation of minors.According to objective interpretative theory,the constituent element of"indecency"in the crime of forced obscenity and child molestation should include"cross-space indecency via the Internet".In terms of judicial application,reference and inspiration for handling such cases in practice can be provided by clarifying the behavior of"obscenity",the means of"compulsory"and"in public".
