《中华人民共和国档案法》与《中华人民共和国政府信息公开条例》区别及关系探讨

《中华人民共和国政府信息公开条例》与《中华人民共和国档案法》是两类不同的法律法规,它们之间的区别很大,从调整范围上看,前者调整的范围仅涉及政府信息的公开或不公开,范围相当有限,而后者是调整档案全生命过程的法律,范围相当宽泛。从调整对象上看,前者调整的是“政府信息”,后者调整的是“档案”。“档案”与“政府信息”并不是同一事物,两者并不相等。从服务对象上看,前者服务对象主要是“公民、法人和其他组织”。后者服务对象包括接收进馆档案的组织机构、馆藏档案相关的当事人及组织机构以及社会各方面的其他人员。两者有这么多的不同,自然其各自的立法思想也就不一样,前者名称就是“政府信息公开”,其立法思想就是要围绕着“政府信息公开”来确立,而后者是全面管理档案全生命过程的法律,其立法思想也要围绕着全面管理档案全生命过程来确立。前者负责“政府信息”的公开,后者负责“政府信息”中不予公开的“政府信息”的开放,这才是两者相衔接的关系。
