摘要
共享电动单车在我国城市的快速发展,在给人民群众带来便利的同时也产生很多问题。治理这些问题必须依据一定理论。首先明确共享电动单车的准公共物品属性,进而明确政府对其负有监管职责;其次现代公共管理讲求善治,在当代中国就是要“以人民为中心”,共享电动单车治理必须围绕这个中心不断改进;再次必须实现共享电动单车治理的法治化,不仅要尽快地立法还要实现“良法善治”,即围绕“以人民为中心”进行立法并执行。从这些理论及其他相关理论出发制定相应对策,才能解决前述问题。
The rapid development of shared electric bikes in China's cities has brought convenience to the people while also posing many problems.Addressing these issues must be based on certain theories.Firstly,the quasi-public goods attribute of shared electric bikes is clarified,and thus the government's regulatory responsibilities towards them are made clear.Secondly,modern public management emphasizes good governance,which in contemporary China means being"people-centered".The governance of shared electric bikes must continue to improve around this center.Thirdly,the legalization of shared electric bike governance must be achieved,which not only requires legislation as soon as possible but also the realization of"good laws and good governance",namely legislation and enforcement centered around the"people-centered"approach.Formulating corresponding countermeasures based on these and other related theories is the only way to solve the aforementioned problems.
