破产企业留守人员劳动关系认定问题研究

On the Identification of Labor Relations of Retained Employees in Bankrupt Enterprises

摘要 随着近年来破产案件的增加,企业留守人员的用工问题逐渐凸显,不同法院的判决思路存在差异。在企业宣告破产后,劳动合同的终止与破产法中尚未履行完毕的合同有一定契合;对于不同留守主体而言,宣告破产后的劳动关系认定应当以劳动合同终止主体为脉络,遵循具体问题具体分析的原则,对法定留守人员与指定留守人员采取不同的处理方式;针对留守人员的劳动关系纠纷仍应坚持劳动仲裁前置。破产企业及其破产管理人、人民法院、行政机关应当在破产案件中关注劳动合同终止与留守人员的工作性质问题。 With the increase in bankruptcy cases in recent years,the employment issues of retained employees in enterprises have gradually become prominent,and there are discrepancies in the judgment ideas of different courts.After a company is declared bankrupt,the termination of labor contracts has a certain correlation with the contracts that have not yet been fulfilled under bankruptcy law;for different retained subjects,the identification of labor relations after the declaration of bankruptcy should be based on the subject of labor contract termination,following the principle of specific analysis for specific issues,and adopting different handling methods for statutory retained personnel and designated retained personnel;disputes regarding the labor relations of retained personnel should still adhere to the principle of labor arbitration as a prerequisite.Bankrupt enterprises,their bankruptcy administrators,people’s courts,and administrative agencies should pay attention to the issues of labor contract termination and the nature of work of retained personnel in bankruptcy cases.
