摘要
为维护用人单位与员工的合法权益,双方在建立劳动关系之初,必须签订书面劳动合同,以明确双方的权利和义务。然而,我国现行的劳动合同解除制度尚不健全,其规定缺乏足够的操作性,难以实现雇主与员工利益的平衡。因此,劳动合同解除的途径、条件和程序成为了热议的焦点。本文将分为三个部分:第一部分将阐述劳动合同解除制度的基本概念和解除方式;第二部分将分析我国劳动合同解除制度存在的问题;第三部分将针对这些问题提出改进建议。
In order to safeguard the legitimate rights and interests of employers and employees,both parties must sign a written labor contract at the beginning of establishing a labor relationship to clarify their rights and obligations.However,the current labor contract termination system in China is not yet sound,and its provisions lack sufficient operability,making it difficult to achieve a balance between the interests of employers and employees.Therefore,the ways,conditions,and procedures for terminating labor contracts have become a hot topic of discussion.This article will be divided into three parts:the first part will elaborate on the basic concepts and termination methods of the labor contract termination system;The second part will analyze the problems existing in China's labor contract termination system;The third part will propose improvement suggestions for these issues.
