An Inquiry into Constructing the Chinese Legal System for Overseas Investment

我国海外投资法律体系的建构应该在借鉴世界先进立法经验和模式的基础上 ,选择“基本法与单行法并行”的立法模式 ,确立“先单行法 ,后基本法”的立法道路。以海外投资法的调整对象为逻辑支点 ,构筑以《海外投资法》为基本法 ,以《海外投资监管法》、《海外投资保险法》的诸多单行法为补充 ,国内法与国际条约相协调 ,实体法与程序法相结合 ,法律、法规、行政规章配套的 ,具有系统性、动态性和国际性特点的多层次的法律体系。

The construction of the Chinese legal system for overseas investment use foreign advanced legislative experiences and models for reference, choose the legislative model of 'parallel basic and special law' and establish the legislative approach of 'special law first, basic law second'. A systematic, dynamic and international multiple legal system should be built on the logical basis of regulating object of the overseas investment law, with Overseas Investment Law as the basic law, such special laws as Overseas Investment Regulation Law and Overseas Investment Insurance Law as supplements, coordinating domestic law and international treaties, combining substantive and procedural laws, and integrating laws, regulations and administrative rules.
