摘要
2001年新婚姻法的出笼,保留了原有法律对军婚的保护条款,肯定了保护军婚的立法原则。保护军婚是我们党和国家的一贯传统,对军人婚姻实行特别保护与婚姻自由并不矛盾,对于军人离婚问题的处理应依据法律和有关司法解释具体问题具体分析,面对新形势下军婚保护的新情况和新问题,还应进一步完善军婚民事特别保护法律制度。
Protecting the marriage with one partner in military service is a consistent policy of our country,which is significantly embodied in both Marriage Law and Criminal Law.With the development of the Chinese society,the provisions concerning this area have been gradually revised and improved.The New Marriage Law,issued in 2001,has retained the updated version of the provision.This paper mainly dwells on ways to apply the provision in practice,its meaning to our servicemen as well as its limitations.
