Research on Distinguishing Accomplishment from Attempt of the Crime of Making Arrangement for Another Person to Illegally Cross the National Border(Frontier)

通过对组织他人偷越国(边)境罪的犯罪形态,被组织人在行为人的安排下偷越国(边)境成功是否为组织他人偷越国(边)境罪的法定构成要件,加重构成犯是否存在犯罪既遂与犯罪未遂的认定和区分及符合组织他人偷越国(边)境罪的加重构成,组织他人偷越国(边)境罪是否既遂四个问题的探讨,认为组织行为是否实施完毕才应当是判断组织他人偷越国(边)境罪的既遂与未遂的标准。

There are many different standards on distinguishing accomplishment from attempt of the crime of making arrangement for another person to illegally cross the national border(frontier) in the academic of Criminal law and the judicial department.The author makes a conclusion that organizing act accomplished or not is the only correct standard by researching on the situation of the crime,the essential factors of the constitution of the crime,crime with heavier result or heavier circumstances can be distinguished accomplishment from attempt or not and the crime is accomplished or not if heavier result or heavier circumstances appears.
