略论海洋法中的警察权

On Police Power of The Law of Sea

海洋法规定了沿海国在不同海域的主权、主权权利、管辖权及管制权,这些权利的具体内容构成国家权力。警察权是国家权力的强力保证,《联合国海洋法公约》的规定中实际上包含着警察权的行使,而且,沿海国使用警察权维护海洋法所规定的权利比使用军事力量更符合海洋法的立法原则。

The law of sea is the branch of the International law,which is about the legal status of sea area and the sum of the principle and system about guiding the nation to utilize different sea area. The United Nation's Convention on the Law of Sea rules coastal countries whose sovereign rights, dominion rights,jurisdiction and managed power in the different sea regions,these rights would come true mostly according to performing the Police Power.In fact,it not only excels operation but also accords with lawmaking of the law of Sea that police power be performed.
