海上执法对船武力使用之装备条件探析

Equipment Conditions of Vessel/Helicopter on Vessel UOF for MLE Operations

在海上执法对船武力使用中,因武力使用不当或过度而引起的纠纷已不是个案,其中除了需要对武力使用的层级、条件进行严格规制外,还需考虑装备技术条件所带来的限制性约束。本文介绍了非致命性武器攻击、鸣枪示警、警告性拦阻射击和失能射击四种目前海上执法对船武力使用常用射击制控方法,分析了这些制控方法的特点和实施操作的可行性,提出了与这些制控方法相应的装备技术条件要求。

There are many cases of disputes and controversies in maritime law enforcement(MLE)operations because of improper or undue use of force(UOF).There are a variety of restrictive constrains caused by the equipment conditions,in addition to the controlling to die UOF continuum and service conditions severely.This paper presents four types of tactical control(TC) methods,which can be divided into non-lethal weapon attack,warning shot,intercept fire for warning and disable fire in common vessel or helicopter on vessel UOF,analyzes the characteristics of TC methods and their feasibilities to execute,and proposes the requirements of equipment corresponding to die TC methods.
