在建设海洋强国和法治国家的大背景下,维护国家海洋权益是战略命题,也是法律命题。应当坚持海洋维权与维护国家综合安全与利益相统一、海洋维权与综合国力相匹配的原则,研究当前国家海洋维权的现实和法治困境,构建系统化的治理海洋的法律规范、实施、监督、保障体系,提高经略海洋的法治能力,切实提升维护国家海洋权益的整体能力。

Under the background of marine powers and rule of the law, maintaining the maritime rights and interests is a strategic proposition and also a legal proposition. we ought to adhere to the principles to unify safeguarding China's sovereignty, security and development interests, match maintaining the maritime rights and interests with enhancement of overall national strength. We need to analyze the current reality and legal predicament of China's maintaining the maritime rights and interests so as to construct systematic legal norms, implementation, supervision and security system on ocean governance, improve legal ability of planning and managing the ocean and enhance the overall level of maintaining China's maritime rights and interests.
