我国海警执法武力使用的程序规制

The Procedure Regulation of Force-Using by China Coast Guard

经大部制改革整合了我国海警队伍,结束了海上多部门分散执法的混乱局面。但是,配套法律规定尚未出台,执法依据和程序规范尚未明确,整合后的海警队伍在执法实践中常常感到无所适从。在当前严峻复杂的海上执法形势下,海警队伍必然要使用武力来保障执法活动的顺利进行。立足海警执法武力使用现状,并从法律程序角度探析原因,在海警武力使用程序上提出事前、事中、事后程序的构建,为规范海警武力行为和提高执法效能提供借鉴。

The structural reform has integrated China Coast Guard and finished the chaotic law-enforcing situation of multi-sectoral decentralization in marine department. However, the corresponding laws have not been issued, and the law enforcement and procedures are not yet clear.Therefore, it is difficult for China Coast Guard to perform laws practically. Nowadays, with the complicated circumstances in marine enforcement, it is necessary for China Coast Guard to use force to ensure implementation of laws successfully. This paper, based on current force-using situation,analyzes the reasons from aspect of legal procedure and put forward the construction before, during and after the force-using. This paper will provide a reference for regulating the use of force for China Coast Guard and improving effectiveness of law enforcement.
