海峡两岸海上维权执法合作初探

A Preliminary Study on Maritime Rights Protection and Law Enforcement Cooperation across the Taiwan Straits

海峡两岸对海洋的战略认知相同,对争议海域的主权立场相近,且有海上合作的历史经验,双方的海上维权执法合作具备必要性与可行性。虽然目前海峡两岸处于分治状态,双方海上维权执法合作受到两岸政治分歧、域外国家干扰等因素影响而面临困境,但两岸海上维权执法合作是双方海洋管理发展的必然趋势,两岸应以"九二共识"为基础,增进互信,以中国海警局与台湾"海巡署"为主体,加强沟通联络,建立规范化的海上维权执法合作机制。

Both sides of the Taiwan Strait have the same strategic understanding of the oceans and have similar sovereignty positions in the disputed sea areas, and they also have historical experience in maritime cooperation. The cooperation of maritime rights protection and law enforcement by both sides are necessary and feasible. Although the two sides of the strait are in a state of being divided at present and their cooperation is confronted by the political differences between the two sides of the Taiwan Straits and the interference by other countries outside the area, the cooperation of maritime rights protection and law enforcement across the Taiwan Straits is an inevitable trend for the development of maritime management. Both side should base on "1992 Consensus" and enhance mutual trust. The main cooperation agencies are China Coast Guard and Taiwan's Coast Guard. Both sides should strengthen communication and establish a standardized cooperation of maritime rights protection and law enforcement.
