Preliminary research on force application for sea right protection for sea right protection of the coast guard under the new mechanism

海警队伍整体划归中国人民武装警察部队领导指挥后,海警海上维权使用武力问题还缺乏明确具体的规定,有必要进行梳理和澄清。本文从使用武力的内涵界定入手,分析了海警海上维权可能使用武力的情形、使用武力的基本原则、并在操作层面上提出了相应建议。

Although the Coast Guard has been reorganized into the PLAAF, the regulations about force application in terms of sea right protection, which in urgent need to be elaborated, haven’t been clarified yet. The essay begins with the definition of force application, then analyses the possible situation, principles and practical measures where force application might be involved.Advices are given accordingly.
