构建我国管制性征收制度的思考

Thoughts on the Construction of Regulatory Collection system in China

管制性征收作为一个舶来的学理概念,发端于美国,在我国立法中还未被采纳,但是事实上的管制性征收行为在我们生活中已经存在。从北京机动车限行为例,从中国国情出发分析管制性征收的性质、合法性以及必要性,认为我国有必要建立并完善管制性征收制度,以保护公民的合法权利,达到权利与权力之间的平衡,更好地推进全面依法治国战略。

Regulatory expropriation,as an imported theoretical concept,originated in the United States.Although it has not been adopted in the legislation of our country,the behaviors of regulatory expropriation already exist in our life.Taking the traffic restriction of motor vehicles in Beijing as an example,this paper analyzes the nature,legitimacy and necessity of regulatory expropriation in the light of China’s national conditions,and holds that it is necessary for our country to establish and improve the regulatory expropriation system in order to protect the legitimate rights of citizens.We will achieve a balance between rights and power and comprehensively advance the rule of law in China.
