关于应否赋予社区矫正执法人员警察身份问题的研讨

On Whether the Community Correction Staff Should Gain Their Status as Police

在我国社区矫正工作的探索和实践取得一定成效的背景下,应当厘清社区矫正执法人员的身份归属问题。对于应否赋予社区矫正执法人员警察身份这一重要话题的探讨,有助于在立法层面上明晰社区矫正执法人员的身份与职责内涵,也会对日后社区矫正工作在我国的顺利开展有所裨益。警察身份的职责与社区矫正的性质之间存在一定程度的契合,为此,应当承认社区矫正工作队伍中配备警力的必要性。但是,社区矫正工作人员的队伍建设应当以社区矫正的特质为出发点,以实现监管、矫正与帮扶的主要目标为落脚点,尽量避免警察身份对社区矫正的贯彻落实可能造成的不利影响。在完善我国社区矫正执法队伍的过程中也应当参照联合国公约的指导原则。就社区矫正制度的完善而言,宜从自身出发,将重点聚焦于完善社区矫正的立法规定、培育锻炼社区矫正的专业队伍、充分动用社区矫正的社会力量并开发利用社区矫正的信息技术,以从制度完善的角度彻底回应社区矫正执法人员应否赋予警察身份这一纷争。

While some achievements have been made in exploration and practices of community correction in China,it is necessary to clarify the status of community correction staff.To discuss whether the community correction staff should gain their status as police is helpful to clarify their status and responsibilities from a legislative perspective and to push China’s community correction forward in the future.Police’s duty is in accordance with the nature of community correction to a certain extent.For this reason,attention should be paid to the necessity of deploying police force in community correction and actively respond to the realistic needs in the process of community correction in China.However,as far as the team construction of community correction is concerned,its characteristics should be regarded as the starting point,the main tasks of supervision,correction and support should be taken as the foothold,and the possible adverse effects police’s status has on the implementation of community correction should be avoided.Reference should also be made to the guiding principles of the United Nations conventions in the process of perfecting the law enforcement team of community correction in China.In addition,in order to thoroughly respond to the disputes over police status,the improvement of community correction system should be based on itself,focusing on the improvement of its legislative provisions,training a professional team,making full use of social resources,and developing and utilizing the information technology.
