刑法中“或者”语义探微

A Semantic Probe into"Huozhe"in Penal Law

刑法是我国一部非常重要的法典,其中的"或者"多达991个,它们都有特定的表意目的和环境,并形成了相应的语言现象,在成文法系中,法律条文实际上是对特定语言的具体运用,而且法律语言先天性要求缜密,无懈可击,这就为逻辑的使用提供了必要性。从逻辑角度,在相容与否、联言和选言、穷尽与否等三方面对"或者"的逻辑语义进行分析,目的是在法律条文中"或者"的使用问题上,条理清晰,目的明确,有助于人们正确理解和运用刑法条文。

The Penal law is a significant code in China in which the employment of 'Huozhe' is more than 991.They have specific ideographs and settings,and furthermore form a relevant language phenomenon.In statute law,each clause is a concrete application of specific language.At the same time law language congenitally needs to be deliberate,unassailable which offers necessity for logic.A logical sematic proble is made into'Huozhe' from logical angle at three aspects :compatible or not;association and disjunctive;definite way in law clauses so as to limit or not.The purpose is to help apply 'huozhe' in a well-organized and definite way in law clauses so as to enable us to understand and apply properly the clauses in penal law.
