摘要
在房屋交易中,中介(本文取狭义)机构是连通出租人与承租人、卖方与买方之间的重要一环,中介行为的"越轨性"直接破坏了房地产交易市场的管理秩序及健康发展。在美国等国家,房产中介作为一个较为成熟的角色,对职业本身的要求以及工作的流程均有明确的规定,反观我国,部分中介机构的行为仍显混乱,缺乏应有的规范性。当我们将中介的违法行为逐一展开,反思法律法规对违法行为的整治现状,不难发现民法的局限性以及刑法介入的迫切性。然而,当我们考量到对中介机构及其从业人员的刑事追责直接影响到房地产市场的快速、有序发展时,我们又必须反思刑法介入的合理性,进而采取刑法审慎介入的方式。
In housing transaction,the real estate agency is the important connection of between the lessor and the lessee,as well as the seller and the buyer.The mediation behavior of'deviant'directly damage the management order of the real estate market and healthy development. As a relatively mature in the United States,the real estate agent has clear definition of the requirement to the profession itself and the process.In China, however,it is chaotic,and lack of standardization.When we unfold the illegal actions one by one and reflection the law regulation of the present situation,it is not difficult to find that the urgency of the limitations of civil law.The use of criminal law has the urgency.However,if the criminal law may directly affect the development of the real estate market,we must reflect on the rationality of criminal law with more patience and prudent intervention.
