行政辅助行为研究——基于《中国行政审判案例》(第125号)而展开的分析

行政辅助行为是源于中国行政审判案例(第125号)裁判要旨的概念,本文通过对该裁判要旨的分析,提炼出关于行政辅助行为的概念定义、审查规则与救济规则,但同时发现这三个表述均存在需要进一步明确和阐述之处。本文第一部分通过对中国行政审判案例(第125号)的分析,展示了其裁判要旨对行政辅助行为的界定和论证,并结合我国行政委托和我国台湾地区行政助手的理论,提出行政辅助行为在实施主体、行为方式、产生方式和行为内容方面的四个构成要件;第二部分在对裁判要旨审查规则的分析基础上,以裁判案例作为论据,提出了行政辅助行为附带性审查的观点,即在对行政辅助行为所依附的行政行为的审查中,附带地对其是否符合四个构成要件进行判断:若不符合构成要件,辅助行为所在的环节便因此存在瑕疵,其依附的行政行为有可能得到不利判决;若符合构成要件,其依附的行政行为还需满足行政诉讼对其本身的审查要求;第三部分在对国家赔偿责任构成要件和归责原则分析的基础上,认为行政辅助行为造成的损害应由作出原行政行为的行政机关承担国家赔偿责任,适用违法归责原则与过错归责原则,最后对行政机关向行政辅助人追偿的条件进行了说明。

This thesis extracts three statements—the definition, the judicial review rules and the relief rules of the Administrative Assistance Action(AAA), a concept which derived from the judge gist of No. 125 Chinese Administrative Trial Case,based on the analysis of the judge gist of the case. However, this three statements needs further clarification and elaboration.The first part of this thesis shows how the AAA is defined and demonstrated by judge gist based on the analysis of the No. 125 Chinese Administrative Trial Case and proposes four constitutive requirements of AAA—Implementing subject, behavioral mode,generating way and content of behavior combine with the research Chinese administrative entrustment theory and administrative assistant theory of Taiwan.The second part of this thesis proposes the idea of incidental review of AAA, which means determining whether or not the four constitutive requirements are achieved in the process of judicial review of the basic administrative action based on the analysis of the judicial review rules of the judge gist and use judge cases as an argument.The third part of this thesis argues that illegality imputation principle and fault imputation principle should apply to the damage caused by AAA based on the analysis of the constitutive requirements and imputation principle of State Compensation Law, and explains the condition for recoupment at last.
