党的十八届四中全会鲜明提出了"依宪治国"、"以法行政"的总原则,对法治建设作出全面部署。法治的关键是把权力关进笼子,力求最大限度地减少权力扭曲。宪法是根本大法、最上位的法,法治体系的建立,逻辑上首先要动态优化宪法,并在此基础上建立完善的法律体系。我国实现国家治理现代化的目标,必须以法治化建设的进步来提供保障条件。

The fourth plenary session of the 18 th CPC central committee, put forward the general principle of 'governing the country by constitution', 'administrating according to law', and made comprehensive arrangements for construction of the rule of law. The key of legislation is putting the power into the cage, thus we strive to minimize the distortion of the power. The constitution is the fundamental law, the higherlevel law. Establishing of the rule of law system, we should optimize the constitution fi rst in order and logic, establish perfect legal system on the basis. If we want to achieve the goal of 'modernization of the national governance', we must rely on the construction of the rule of law as the safeguard.
