摘要
《侵权责任法》第22条关于精神损害赔偿适用的范围具有重大缺陷。本文从比较视野的考察,支持侵害具有人格利益财产承担精神损害赔偿。同时厘清具有人格利益财产的内涵及其承担精神损害赔偿的特别构成要件。这对于发挥该制度的功能具有重要意义。
'Tort Liability Act,' the spirit of Article 22 has significant shortage on the scope of mental damage.From the comparative perspective,my paper support that whose who punish the property with personal interests would be liability for damages.Also clarify the meaning of property interests with personality and constitute elements of special damages.It is very important for us to play legal function.
