坚持依法治校是新时代坚持全面依法治国基本方略,深化依法治国实践的重要体现。新时代下的依法治校是"法治""法治中国""依法治校"的有机结合。为更好地发挥法治在新时代大学治理中的作用,应厘清法益主体的权利义务关系,实现权义背后利益的平衡协调。面对教育法律体系不完善、大学与政府管理权限不协调、大学内部规章不健全、治理效率较低等难题,应在法治层面精耕细作,坚持以师生为本的群众路线,确立和贯彻落实法治理念,在法律运行的立法、执法、司法、守法环节一以贯之,促进大学治理的法治化和现代化。

In the process of comprehensively advancing the fundamental principle of the rule of law and deepening the rule of law in practice in new era, adhering to govern university by law is an important part. University governance by law in new era is an organic combination of concepts of"the rule of law" " rule of law in China" and " university governance by law". In order to fully exert the role of the rule of law in new era university governance, Stakeholders' rights and obligations need to be clarified. At the same time, the interests behind these rights and obligations need to be balanced. Faced with the present problems that the education legal system is not perfect, the management authority of university and government is not coordinated, the university internal rules is not completed, and the governance efficiency is low, more efforts need to be taken in the practice of establishing and implementing the concept of the rule of law. We also need to take more efforts in manifesting the rule of law through the links of legislation, law enforcement, judicial and law-abiding. In this way, the legalization and modernization of university governance can be promoted.
