转型国家治理的秩序三元观:一个“法律现实主义与多元主义”理论分析

当前对转型与增长问题的研究,无法解释转型秩序、法律改革、国家治理与经济增长之间的复杂关系。本文从规则实施与国家治理的'法律多元主义'和法律现实主义视角出发,以法律不完备性理论为基础,构造了一个关于国家治理的法律、政策与'关系'规则的秩序三元规则实施的理论框架;以该理论框架解释了中俄两国转型过程中所发生的'国家治理与经济增长之谜'.

There are much research on the problem of transformation and development,however,all of them cannot explain the complex relationship among transformation order,law reform,governance and economic growth.This paper has structured a theory frame about the implementation of law in country governance,policies and"guanxi"rules,beginning with the perspective of pluralism in law,which contains rules enforcement and country governance,and legal realism,based on the legal incomplete theory.Then this paper explains mystery between country governance and economic growth happened in the transformation both in China and Russia.Last,this paper makes a prospective prediction and comments about the long-term trend of China’s transformation and country governance.
