基于对现代社会及现代社会科学某些方面的宏观检视,有被忽视之嫌的邻居问题凸显出来。邻居不仅孕育了丰富的法律制度,且其所生规则与国家法律的博弈还应对了法律在社会生活中如何实现的根本命题。把邻居置身于'个人—共同体'序列中进行反身性考察,能够发现邻居规则契合了现代法律的基本气质。作为对吉登斯亲密关系变革理论的扬弃可以结论性的认为,法律很大程度上是按照邻居规则予以设置的。面对现代性下的法律,邻居不仅具有复原功能,还有诊疗意义。

As a macroscopical check on modern society and social science,the notion of neighbor has emerged.The game between national law and nongovernmental rules which come from neighborhood,is a reply to the fundamental proposition that how to carry out law in living society.Putting the notion of neighbor in the pattern of"individual-community"to have a reflexive review,it is recovered that neighbor rules correspond to essential character of modern law.In developing the advantage and discarding the disadvantage of the intimate relationship theory of A.Giddens,there are the conclusions that law is set up by neighbor rules in general and neighborhood has the function of reversion and therapy.
