公众参与建设项目环境影响评价法律问题研究

The Research on Legal Problems of Public Participation in The Environmental Impact Assessment of Construction Project

环境影响评价是我国《环境保护法》的一项重要制度,它具有预防环境破坏、环境污染,保护环境公益等作用。环境影响评价的关键在于公众的有效参与。公众参与建设项目环境影响评价有利于提高决策的科学性和有效性,有利于避免环境污染和破坏的发生。我国现阶段公众参与建设项目环境影响评价还存在诸多问题,需立足我国实践,借鉴域外经验,逐步完善相关制度;扩大公众参与环境影响评价的范围,在环境影响评价全过程吸收公众参与,完善公众参与的方式;规范政府环保信息公开,对公众参与给予资金支持:在有关公众参与环境影响评价的诉讼中,放宽原告起诉资格,适当扩大受案范围,建立环境保护法庭,吸收专家证人和人民陪审员参与庭审,在环境诉讼中停止具体行政行为的执行。

Environmental impact assessment is an important system in the environment protection law which has the function of preventing environmental damage,environmental pollution and protecting environment.The effective public participation is the key of the environmental impact assessment.Public participation in the environmental impact assessment of construction project is helpful to improve the scientificity and effectiveness of the decision-making,which can avoid the environmental pollution and destruction.However,so far this public participation still has many problems in China.So it should be based on the actual situation of our country and use the experience of other countries to perfect the related system gradually.We also need to expand the scope of the public participation in environmental impact assessment,make people participate in all the stages of environmental impact assessment and improve the way of public participation.The disclosure of government environmental information should be standardized and the public participation should be given financial support.Furthermore,in the lawsuit of public participation in the environmental impact assessment,the court ought to extend the scope of the plaintiff,accept more cases,establish environment protection courts,absorb expert witnesses and judicial assessors in the trial and stop the check of environmental impact report.
